Mexico Opens a Debate to Legalize Passive Euthanasia

The PRD Senate has proposed a law that, if approved, will permit the voluntary termination of life under certain conditions.

Passive euthanasia, as most of us know, constitutes ceasing the administration of medications or artificial life support systems for terminally ill patients. On the other hand, active euthanasia consists of inducing the death of a terminally ill patient.

The passive euthanasia law proposal has had very good acceptance in the Health Legislation Senate, says the Secretary of Health Legislation, Lazaro Mazón, from the Mexican Left Wing party; Partido de la Revolución Democrática PRD.

The proposed law is based upon humanistic principles, which respect the terminally ill individual's right to make a responsible and informed decision regarding self-termination. This proposed plan seeks to reform the current Federal Penal Code by creating a new law called "The Suspension of Healing Treatment," or "The Right to a Dignified Death Law."

The basic requirements for the application of such a law would require that the patient is in the terminal phase of a disease, has been diagnosed to die within a period of six months, and that either the or the patient's family (if the patient is incapacitated) have given their consent. In addition, each particular case or situation must be analyzed and approved by the Bioethics committee of the hospital where the patient is hospitalized.

In his address to the Senate, Mazón, referring to the suffering that terminal ill patients have to go through, said, "As a matter of fact, in his last days, even Pope John Paul II asked his doctors to stop his medication and let him die in peace."

Senadores del PRD presentan una propuesta de ley, que de ser aprobada por el Congreso, permitirá la terminación voluntaria de la vida bajo ciertas condiciones. La propuesta de la comisión de Salud de la Cámara Alta ha tenido "muy buena aceptación" entre los senadores, ha dicho el secretario de ese órgano legislativo, Lázaro Mazón, del izquierdista Partido de la Revolución Democrática (PRD.)

La eutanasia pasiva consiste en que a un paciente terminal le dejen de suministrar los medicamentos o le retiren los aparatos que le mantienen con vida artificialmente, mientras que en la eutanasia activa se busca provocar directamente la muerte del enfermo.

La iniciativa de ley se ha basado en principios humanistas y respeta el derecho a la libertad de autodeterminación de los individuos, tomando siempre en consideración que esta libertad se dé de forma responsable e informada, según el PRD.

El plan pretende reformar el Código Penal Federal y crear la Ley General de Suspensión de Tratamiento Curativo, también llamada Ley de Derecho a la Muerte Digna. Los requisitos para que la ley pueda ser aplicada son que el paciente esté en fase terminal, que le haya sido diagnosticada una muerte segura en un máximo de seis meses y que él o su familia, en caso de estar inhabilitado, hayan dado su consentimiento.

Además, el caso particular sometido a análisis tendría que ser avalado por el comité de bioética del hospital donde esté internado el paciente. "Incluso el Papa Juan Pablo II, en sus últimos días, solicitó a sus doctores que no le suministraran más medicamentos, que le dejaran morir en paz", ha dicho Mazón en la tribuna del Senado al referirse al sufrimiento de enfermos en fase terminal.
