ANA Fights Irresponsible Development on Southside PV

Puerto Vallarta, Jalisco, Mexico - In a letter to BanderasNews.com, the Amapas Neighborhood Association writes:

A core goal of the Amapas Neighborhood Association (ANA) and major priority of our members is Responsible Development - supporting new construction that respects its neighborhood and its neighbors, and obeys the zoning laws. That's why we sponsored and financed the District 9 Plan Parcial, which was passed into law by the City Council in September, 2012.

As you may have heard, D'Terrace - the nine-story condominium tower now under construction on a small side-street across from the Tropicana Hotel in the heart of Amapas - is being built under a construction license allowing height and density far in excess of what the Plan Parcial allows. It is represented by Applegate Realty, with whom ANA has met. Despite knowledge and understanding of the problem, Applegate has continued to aggressively market the project.

As recently reported in 'La Tribuna' (article translation HERE) and on our website, the ANA has brought this problem to the attention of PRODEUR, an office of the Jalisco State Attorney General, and PRODEUR has announced they will file a lawsuit contesting the permit's validity. If the lawsuit is successful, the construction license could be annulled and the judge could order D'Terrace demolished. But lawsuits - even by government agencies - take time. While the clock ticks, construction and sales to unwary clients continue... and so does the problem.

So, until there's court action defending the Plan Parcial, we need your help.

ANA Notification to AMPI

AMPI (the professional real estate association of Vallarta) has internal rules that agents must notify clients of potential problems with a property. ANA has therefore notified AMPI that D'Terrace exceeds the limits of the Plan Parcial by roughly double, in a letter available (HERE) on our website.

While AMPI has received this letter, it refused to sign for it, as requested. Why would AMPI refuse to acknowledge receipt, except so its agents would not be obligated to disclose D'Terrace's problem permits and pending PRODEUR lawsuit to their clients?

We need your help!

Please take the time to contact the real estate agent or agency you used when you bought your property - in person, by phone or email - and tell him, her or them that you support Responsible Development in Amapas, and you hope they do too. And that support should mean not only respecting the local zoning laws, but not representing or selling properties that don't. Tell them about the ANA's notification and the PRODEUR lawsuit - and send them a link to our website's article.

We are making a stand on this project because it is such a blatant violation of the Plan Parcial, and we need your help to do so. It will set an example for future development in the Amapas neighborhood.

If your agent or agency hears from enough of us, they'll take their responsibility seriously, as you are their clients. We need the support of responsible agencies, some of whom are members of ANA, to support responsible projects and keep irresponsible, abusive and unlawful developments off the market.

Your opinion matters. Please make your voice heard. Construction and sales have already begun on the D'Terrace project. Make that personal contact, that call, that email, now - today. Before it's too late.
